Definitions

 

“We”/“our”/”us”/”our site”/”the website”/”the company”/”Al-Mahdi Dental Supplies” refers to Al-Mahdi Dental Supplies which is a business registered in Scotland, 1 Wellpark Court, Kilmarnock, KA3 7BX. Website: www.al-mahdi-dental-supplies.com

“The customer” refers to any firm, company, person or persons who use our website or purchase or agree to purchase goods from Al-Mahdi Dental Supplies.

“This document” refers to this “Terms and Conditions” document. 

“Goods” refers to any item or service being sold by Al-Mahdi Dental Supplies. 

“Order” refers to the customer's order of goods from Al-Mahdi Dental Supplies. 

“Consumer” refers to an individual acting for purposes which are wholly or mainly outside their trade, business, craft or profession

“Contract” refers to the legally binding agreement between the company and the customer.

Check-list Before Your Dental Chair Order

 

1. Is the dental chair's floor control box to be positioned inside (built-in) or outside (external to) the chair?  

2. Does your surgery have appropriate suction/vacuum and Compressor system for the chair? (Amalgam separator is required for UK suction systems). 

3. Do you have appropriate plumbing and electronics installed for the chair?

4. Is your surgery large enough for the chair dimensions

5. Is the chair intended for left handed or right handed use?

6. Do you need a UK power plug or is the chair intended for a different region? 

7. Do you need 2 hole, 4 hole or 6 hole tubing for the hand piece attachments? (The chairs come with 4 hole tubing as standard)

8. Do you need fibre optic tubing for the highspeed attachment? 

9. Do you need new high speed/slow speed handpieces, ultrasonic scalers and matching scaler tips? 

10. Do you need any dental chair add-ons? (VOKODAK Add-ons / CINGOL Add-ons)

    Prices and Payment

     

    • In accordance with Scottish law, Al-Mahdi Dental Supplies was not required to be VAT registered at the time of publishing of this document. We have therefore chosen not to be VAT registered initially in order to keep the costs down for our customers and be more competitive in the dental supply market. However, when VAT registration becomes a legal obligation to us, all published prices will be net and exclusive of VAT (price including VAT will be clearly presented as well). VAT will be charged on all invoices at the appropriate rate (except on items which are zero rated). 

    • This online price list supersedes all previous price lists. We reserve the right to amend these prices at any time and to correct omissions and errors. Prices are subject to change without prior notice.

    • Payment of the price of goods (and VAT when/if required) can be made directly by the payment method(s) available on our site or by invoice (for orders less than £500 ). Payment of the price of goods by invoice is due 30 days from the date of the invoice. If the customer is in default in paying any sum as and when it becomes due, Al-Mahdi Dental Supplies shall have the right to suspend all further deliveries until the default is made good.

    • In the event that the Customer fails to pay any monies by the due date,  a penalty fee may be charged at the rate of 2% per month. The customer shall also indemnify the company against expenditure on all costs of recovery including legal fees on an indemnity basis without limit and any associated costs reasonably incurred. All banking charges incurred by the company in respect of dishonoured payments will be payable by the customer.

    • The company retains ownership of the goods until they are paid in full.

    • Where prices shown are ‘per 5’ or ‘per 10’ etc… the price indicated is the price for each of 5 or 10 units, not the total sale price.

    • The company reserves the right to amend any verbal or written quotations at any time and to correct omissions and errors. Prices are subject to change without prior notice.

    • The company reserves the right to assign their rights with respect to the customer's overdue payments to 3rd parties.

     

    Shipping and Delivery

     

    • Expected delivery time(s) can differ depending on stock availability, shipping or air delivery. The expected delivery time is displayed for individual goods on our website. 

    • The displayed delivery time is referring to the UK. International deliveries might take additional 5-7 work days.  
    • The company reserves the right to charge the customer for delivery, unless free delivery has been stated. Shipping fees are displayed at check-out. 

     

    Goods will be accepted for return on the following conditions:

     

    • The customer has contacted us and given their invoice number and details of the reason for return of goods.  Goods will not be accepted for refund without prior authorisation. 

    • Returned goods must be in a saleable condition (inclusive of all original packaging, unused and unopened except for inspection). All returns must be suitably packaged. Products with “tamperproof” seals cannot be returned once the seal is broken.

    • Returned goods must be received at Al-Mahdi Dental Supplies - 1 Wellpark Court, KA3 7BX, Kilmarnock, UK -  within 30 days from the date of delivery.

    • Returned goods received after this time or without prior authorisation will not be refunded. 

    • Where goods are received by the customer in an unusable condition the customer must inform Al-Mahdi Dental Supplies in writing within 14 days of delivery. 

    • Al-Mahdi Dental Supplies accepts no responsibility for returned goods which are lost or damaged in transit. It is the customer’s responsibility to ensure that goods are adequately labelled and packaged.

    • Providing these conditions are met, upon receipt of returned goods, a full refund will be given to the customer.

    • If the customer has paid postage/shipping to return goods, Al-Mahdi Dental Supplies will fully refund the customer upon receipt of proof of payment. 

    • If these conditions have not been met as stipulated we reserve the right to not to accept the goods for return and not issue a refund.

     

    Operating and Supply Policy

     

    Al-Mahdi Dental Supplies reserves the right to record all telephone calls to or from our company for training purposes and in relation to any contractual disputes.

     

    Responsibilities, Health and Safety at Work

     

    • Al-Mahdi Dental Supplies will retain ownership of the goods until they are paid in full. Customers are responsible for ensuring that they comply with all statutory governmental and local authority regulations in relation to goods purchased from our site. The transfer of risk of damage to the goods shall take place at the moment when the goods leave the company’s possession or control. Where goods are delivered by carrier any claims for loss or damage in transit must be made by the customer against the carrier in accordance with any terms and conditions of business of the carrier.

    • It is illegal to send contaminated goods through the post.

    • Equipment containing mercury must be emptied before return.

    • The details of the method used for sterilisation must accompany the returned item.

    • We reserve the right not to handle items which do not meet the above criteria.

     

    Excluding liabilities

     

    Al-mahdi Dental Supplies does not exclude liability for:

    • Fraudulent acts or omissions. 

    • Death or personal injury caused by negligence or breach of other legal obligations.

     

    Al-Mahdi Dental Supplies is not liable for: 

    • Loss which was not reasonably foreseeable to both parties at the time when the contract was made. 

    • Loss (e.g loss of profit) to the customer’s business, trade, craft or profession. 

     

    Governing law, jurisdiction and complaints

     

    • Products from Al-Mahdi Dental Supplies are intended for the exclusive benefit of, and safe use by, dentists and dental professionals. 
    • The contract (including any non contractual matters) is governed by the law of Scotland. 

    • Disputes can be submitted to the jurisdiction of the courts of Scotland or, where the customer lives in the UK. 

    • We try to avoid any disputes, so we deal with complaints in the following way: If a dispute occurs, customers should contact us to find a solution.  We will aim to respond with an appropriate solution within 7 days.

    Use of Al-Mahdi Dental Supplies Website

     

    • The content of the pages of the website is for the customer's general information and use only. It is subject to change without notice. 

    • Neither us nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. The customer acknowledges that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

    • The customer's use of any information or materials on this website is entirely at the customer's own risk, for which we shall not be liable. It shall be the customer's own responsibility to ensure that any products, services, or information available through this website meet their specific requirements.

    Terms and Conditions

     

    This Agreement is a contract between the Customer and the Owner in regards to hiring a Dental Chair. 

     

    Definitions

     

    1.1: 

    Hirer/Customer means the person hiring the dental chair from the Owner. 

     

    1.2: 

    Owner/Company means Al-Mahdi Dental Supplies. 

     

    1.3: 

    “Chair” or ”Dental Chair” means the entire dental chair unit, but excludes any “add-ons” such as an “intra-oral camera + monitor system” or “handpieces” that are not part of the dental chair unit. 

     

    1.4:

     “Rent” means the monthly subscription paid by the Hirer to the Owner. 

     

    Payment details, contract period, inclusions and services. 

     

    2.1: 

    * One-off fee: £X (as stated on the product page). 

    * Monthly fee: £Y (as stated on the product page). 

    * Contract period: 12 months. 

    No renewal fee if you choose to renew your contract after 12 months. 

    * Includes free delivery & chair installation. 

    * Free maintenance, repairs and engineer services! 

    * After 3 years, the chair is all yours! With additional 2 years warranty!

     

    The "Hire A Chair" range comes with the COMPLETE SERVICE OPTION  as standard

    Purchase options:

    Additional info: 

    *The installation of a dental chair by our engineer team is applicable to mainland UK only. Alternatively the customer can use their own local engineer and we will pay the bill (subject to approval*). The fitting and complete installation of a dental chair can only take place in a surgery that has the  appropriate electrics and plumbing work prepared. The surgery must also have a suitable air compressor and vacuum system in place prior to the chair installation. 

    **Any service or repair of the dental chair will be done by the customer's own local engineer. We will pay the bill (subject to approval*).  

    ***Any spare parts that might be required will be provided for free by Al-Mahdi Dental Supplies or by the customer's own local engineer. We will pay the bill.

     

    *Al-Mahdi Dental Supplies reserves the right to check the legitimacy of a reported chair malfunction before authorising a free repair, spare parts or complete chair replacement. 

     

    2.4: 

    Payment procedure (Example only, prices may change)

     

    Payment procedure:

     

    Step 1

    Add the £1800 "One-off fee" to the cart and pay for the chair to be ordered. 

     

    Step 2

    Once your chair has been delivered and installed in your surgery,  click on the yellow "Set-up Monthly Fee" button. Fill out your details. 

    And that's it!

    Use of Equipment

     

    3.1: The Hirer will use the Dental Chair for the purpose for which it was designed and not for any other purposes. 

    3.2: Unless the Hirer obtains the prior written consent of the Owner, the Hirer will not alter, modify or attach anything to the Dental Chair unless the alteration, modification or attachment is easily removable without damaging the functional capabilities or economic value of the Dental Chair. 

     

    Warranties

     

    4.1: The Dental Chair will be in good working order and good condition upon delivery and installation. 

     

    Loss and Damages

     

    5.1:

    To the extent permitted by law, the Hirer will be responsible for risk of loss, theft, damage caused by improper use, or destruction to the Dental Chair from any and every cause. 

     

    5.2: 

    If the Dental Chair is lost or damaged, the Hirer will continue paying the monthly fee, will provide the Owner with prompt written notice of such loss or damage and will, if the Dental Chair is repairable, put or cause the Dental Chair to be put in a state of good repair, appearance and condition. 

     

    Ownership and Quiet Enjoyment

     

    6.1: 

    The Dental Chair is the property of the Owner and will remain the property of the Owner, unless the Hirer decides to purchase the Dental Chair. 

     

    6.2:

    The Owner warrants that as long as no event of default has occurred, the Owner will not disturb the Hirer’s quiet and peaceful possession of the Dental Chair or the Hirer’s unrestricted use for the purpose for which Dental Chair was designed. 

     

    Indemnity

     

    7.1:

    The Hirer will indemnify and hold harmless the Owner against any and all claims, actions, suits, proceedings, costs, expenses, damages and liabilities, including attorney’s fees and costs, arising out of or related to the Hirer’s use of the Dental Chair. 

     

    Default

     

    The occurrence of any of one or more of the following events will constitute an event of default (“Event of Default” under this Agreement):

     

    8.1: 

    The Hirer fails to pay any amount agreed upon. 

     

    8.2: 

    The Hirer becomes insolvent or makes an assignment of rights or property for the benefit of creditors or filed for or has bankruptcy proceedings instituted against it under the bankruptcy law of the United Kingdom or another competent jurisdiction. 

     

    Remedies

     

    On the occurrence of an Event of Default, the Owner will be entitled to pursue any or more of the following remedies (the “Remedies”):

     

    9.1:

    Declare the entire amount of the Rent for the term immediately due and payable without notice or demand to the Hirer.

     

    9.2:

    Commence legal proceedings to recover the Rent and other obligations accrued before and after the Event of Default, including a £5000 fine for breach of agreement.  

     

    9.3:

    Take possession of the Dental Chair, without demand or notice, without any court order or other process of law. The Hirer waives any and all damage occasioned by such taking of possessions. 

     

    9.4: 

    Terminate the Agreement immediately upon written notice to the Hirer. 

     

    9.5:  

    Pursue any other remedy available in law or equity. 

     

    9.6:

    The Hirer is entitled to the protection and remedies available to them under the Consumer Credit Act 1974. 

     

    Governing law

     

    11.1:

    This Agreement will be constructed in accordance with and governed by the laws of Scotland and the Parties submit to the exclusive jurisdiction of the Scottish courts; or in accordance with and governed by the law of the land of residence of the Customer (for customers outside the UK).  

     

    General terms

     

    12.1:

    This agreement will extend to and be binding upon and inure to the benefit of the respective heirs, executors, administrators, successors and assigns, as the case may be, of each party to this Agreement.

     

    12.2:

    Neither party will be liable in damages or have the right to terminate this Agreement for any delay or default in performance if such delay or default is caused by conditions beyond its control including, but not limited to Acts of God, Government restrictions, wars, insurrections, natural disasters, such as earthquakes, hurricanes or floods and/or any other cause beyond the reasonable control of the party whose performance is affected. 

     

    13:

    Consent

     

    I, the customer,  confirm that I fully understand and agree to the information in this document and that I am legally obliged to pay the agreed monthly fee for a minimum period of 12 months, unless I decide to purchase the chair instead as mentioned above.  

     

    *The Customer (Hirer) is required to send a copy of a proof of ID (passport or driver's licence) and a copy of proof of address (utility bill or invoice with the customer's address) to Al-Mahdi Dental Supplies

    Hire A Scanner! 

    Terms and Conditions

     

    This Agreement is a contract between the Customer and the Owner in regards to hiring an Intraoral Scanner. 

     

    Definitions

     

    1.1: 

    Hirer/Customer means the person hiring the intraoral scanner from the Owner. 

     

    1.2: 

    Owner/Company means Al-Mahdi Dental Supplies. 

     

    1.3: 

    "Intraoral scanner" or "scanner" means the intraoral scanner and all associated equipment that was delivered to the Hirer.

     

    1.4:

     “Rent” means the monthly subscription paid by the Hirer to the Owner. 

     

    Payment details, contract period, inclusions and services. 

     

    2.1: 

    A Brand New Intraoral Scanner For Hire!

    * One-off fee: £500 (Example only, price may differ. See website for updates)

    * Monthly fee: £400 (Example only, price may differ. See website for updates)

    * Contract period: 12 months.

    * Free contract renewal after 12 months. 

    * After 2 years, the scanner is all yours!

    * Early contract termination fee (before 24 months): £1000

    * Warranty: 2 years

     

    2.4:

    Use of Equipment

     

    3.1: The Hirer will use the Intraoral Scanner for the purpose for which it was designed and not for any other purposes. 

    3.2: Unless the Hirer obtains the prior written consent of the Owner, the Hirer will not alter, modify or attach anything to the Intraoral Scanner unless the alteration, modification or attachment is easily removable without damaging the functional capabilities or economic value of the Intraoral Scanner. 

     

    Warranties

     

    4.1: The Intraoral Scanner will be in good working order and condition upon delivery. 

     

    Loss, Damages and Returns

     

    5.1:

    To the extent permitted by law, the Hirer will be responsible for risk of loss, theft, damage caused by improper use, or destruction to the Intraoral Scanner from any and every cause. 

     

    5.2: 

    If the Intraoral Scanner is lost or damaged, the Hirer will continue paying the monthly fee, will provide the Owner with prompt written notice of such loss or damage and will, if the Scanner is repairable, put or cause the scanner to be put in a state of good repair, appearance and condition. 

     

    5.3:

    Returns (before 24 months): The Hirer will send a video to demonstrate that the scanner is in good working condition prior to being returned to the owner and that it will be delivered with suitable packaging. The Hirer pays the delivery (for returns). 

     

    Ownership and Quiet Enjoyment

     

    6.1: 

    The Hirer will be granted full ownership of the scanner and any associated equipment after 24 months.   

     

    6.2:

    The Owner warrants that as long as no event of default has occurred, the Owner will not disturb the Hirer’s quiet and peaceful possession of the Scanner or the Hirer’s unrestricted use for the purpose for which it was designed. 

    Indemnity

     

    7.1:

    The Hirer will indemnify and hold harmless the Owner against any and all claims, actions, suits, proceedings, costs, expenses, damages and liabilities, including attorney’s fees and costs, arising out of or related to the Hirer’s use of the Intraoral Scanner. 

     

    Default

     

    The occurrence of any of one or more of the following events will constitute an event of default (“Event of Default” under this Agreement):

     

    8.1: 

    The Hirer fails to pay any amount agreed upon. 

     

    8.2: 

    The Hirer becomes insolvent or makes an assignment of rights or property for the benefit of creditors or filed for or has bankruptcy proceedings instituted against it under the bankruptcy law of the United Kingdom or another competent jurisdiction. 

     

    Remedies

     

    On the occurrence of an Event of Default, the Owner will be entitled to pursue any or more of the following remedies (the “Remedies”):

     

    9.1:

    Declare the entire amount of the Rent for the term immediately due and payable without notice or demand to the Hirer.

     

    9.2:

    Pursue any other remedy available in law or equity. 

     

    9.6:

    The Hirer is entitled to the protection and remedies available to them under the Consumer Credit Act 1974.

    Dental Chairs - Service Options
